BREAKING: ConCourt dismisses Chamisa poll challenge

THE Constitutional Court (ConCourt) has dismissed MDC Alliance leader and losing presidential candidate Nelson Chamisa’s poll challenge and further endorsed President Emmerson Mnangagwa’s win as announced by the Zimbabwe Electoral Commission 3 August.

Announcing the ruling this Friday afternoon, Chief Justice Luke Malaba said Chamisa, through his lawyers, failed to convince the apex court that indeed the July 30 election was rigged in favour of the incumbent.

The country’s top judge said Chamisa failed to provide primary evidence in terms of V11 forms which would have assisted the court to arrive at an undeniable verdict but made “several generalised allegations” against ZEC which were “debunked” by the electoral authority.

Chief Justice Malaba said the onus to prove a case of rigging was on the applicant who however failed to exhaust all legal remedies that would have assisted him build a strong case to assist the court.

The top jurist said Chamisa failed to “provide clear, direct, sufficient, and credible reasons” that the alleged reasons cited marred the poll.
