LATEST: ConCourt bans sex with girls below 18

The Constitutional Court (ConCourt) has raised to 18, the age from which girls could consent to sex.

Until this Tuesday, the legal age of consent was 16 years.

Prominent Harare lawyer and legislator Tendai Biti successfully secured the elevation of the age of consent to 18.

“BREAKING NEWS: The constitutional court has just handed down a judgment in a case argued by our principal @BitiTendai holding that the age of sexual consent is 18 not 16. Provisions of the law that held that the age of consent is 16 have been struck down…” read a Twit Tuesday by Tendai Biti Law Firm.


Biti is the lawyer who also secured a landmark judgement that outlawed marriage of those below the age of 18.

The 2016 ruling by the Constitutional Court followed an application by two women who sought to have the legal age of marriage moved to 18 for both men and women.

Following the ruling, there remained a mismatch between the age of consent which stood at 16 and the legal age of marriage which was now 18.

Consequently, people could indulge in lawful sex and even impregnate girls under 18 for as long as they did not marry them.
