Poor health saves Marry Mubaiwa from jail, fined $60 000

A Harare magistrate has imposed $60 000 fine on Marry Mubaiwa after the unwell estranged wife to Vice President Constantino Chiwenga was found to be a likely burden to officers if community service or jail was preferred instead of the fine.

Mubaiwa was Wednesday found guilty of breaching the Marriage Act through false claims she had agreed with Chiwenga to solemnise the couple’s marriage.

This happened when the VP was fighting for his life in an Indian hospital some time ago.

In his ruling, magistrate Lazini Ncube set aside a 12-month jail term on condition she does not commit a similar offence within five years.


Ncube said Mubaiwa deserved a second chance and incarceration would worsen her health condition.

He said her condition will not allow her to perform community service and would be a burden to officers where she is going to perform the unpaid work.

The former model’s health challenges have taken centre stage in a case in which her trial for a slew of alleged crimes should be.

Mubaiwa has, during her trial, sometimes been brought in court on a stretcher.
