In a landmark ruling this Tuesday, the High Court has blocked by-elections in legislator Tendai Biti’s Harare East and five other opposition constituencies whose MPs were recalled from parliament last year by the Lucia Matibenga-led PDP faction.
“The court set aside the proclamation made declaring the seats vacant. It further ruled that the ruling effectively stands despite appeal and ordered their reinstatement in Parliament,” read a message from opposition sources.
The other constituencies include Willias Madzimure’s Kambuzuma, Settlement Chikwinya (Mbizo), Kucaca Ivumile Phulu (Nkulumane), Sichelesile Mahlangu (Pumula) and Regai Tsunga’s Mutasa South.
The MPs were expelled from parliament in March last year at the behest of one Benjamin Rukanda, purporting to be PDP secretary general.
This followed the main opposition’s endless squabbles that have seen former allies who were granted legal rights to the party wield the axe on rivals.
The nomination court sits this Wednesday to receive entries from candidates wishing to contest for by-elections March 26 this year.
